"You (referred to as 'you,' 'End User,' 'your,' 'Buyer,' or 'Customer') are kindly requested to carefully review and accept all the stipulations outlined in this Bespoke Tailoring Agreement ('Agreement' or 'Terms and Conditions' or 'TERMS AND CONDITIONS' or 'Terms') and the associated Privacy Policy before utilizing www.versuitality.com (hereinafter known as the 'Site' or 'Versuitality Tailoring' or 'we' or 'our'). The Site provides you with the opportunity to explore, choose, and acquire tailor-made garments ('Apparel' or 'Products' or 'Services').
Your utilization of this website www.versuitality.com (referred to as the 'Site') and its affiliated sites, services, and tools is subject to these TERMS AND CONDITIONS. These terms become effective upon acceptance and govern the interaction between you and Versuitality Tailoring, an entity Incorporated under The Indian Partnership Act,1932, with its registered office at No.1-2-271/3F/1,2,3,4,5& 6,SHREE ARCADE,S.D.ROAD,SECUNDERABAD,TELANGANA-500003 (hereinafter referred to as the 'Company'), encompassing the sale and provision of any Products on the Site. In case of any conflict between this AGREEMENT and any other document, these TERMS AND CONDITIONS shall take precedence for the use of the Site. If you do not concur with the provisions of these TERMS AND CONDITIONS and the Privacy Policy, kindly refrain from using the Site. For the purposes of this AGREEMENT, 'Acceptance' denotes your affirmative action, such as clicking the 'check box' and the 'continue button' on the registration page or any similar actions implying your acceptance.
The Company reserves the right to modify this Agreement and/or the Privacy Policy at its discretion by publishing an updated version on the Site. All revisions and amendments will be communicated to you through website posts or email notifications. The updated version becomes effective upon posting on the Site, and your continued use of our Site implies your agreement to the revised TERMS AND CONDITIONS and Privacy Policy presented herein.
Moreover, if the revised Agreement includes a Substantial Change, a 30-day prior notice of such change will be provided to you based on the Notification Preferences you have indicated. It is advisable to regularly check for any modifications or updates to the terms and conditions outlined in this Agreement. In this context, 'Substantial Change' refers to any alteration to the terms of this Agreement that significantly diminishes your rights or increases your responsibilities."

These terms & conditions, subject to modifications or amendments, establish a bespoke agreement between our tailoring establishment and you. Upon engaging with, utilizing, or patronizing our tailoring services (or any future services offered by our establishment), you acknowledge and accept these terms and conditions. Moreover, when availing yourself of any existing or forthcoming services provided by our establishment, or making purchases from any business affiliated with us or third-party vendors, whether integrated into our services or not, you are also bound by the respective guidelines and conditions applicable to such services or merchants. In cases of inconsistency between these conditions and the specific guidelines, the latter shall prevail.
If any conflicts arise between these Terms and Conditions and other documents, these Terms and Conditions will take precedence for the purpose of using our tailoring services. As a prerequisite for your purchase, we seek your consent to send you administrative and promotional communications. We will notify you of your account activity and purchases, in addition to updates on our bespoke offerings and promotional opportunities. You retain the option to unsubscribe from our promotional communications at any time by clicking the UNSUBSCRIBE link at the bottom of any email correspondence. Please refer to our Privacy Policy for further details. We disclaim any responsibility for any promotional emails or SMS/MMS sent to you. The offers presented in these communications are subject to change at the sole discretion of our establishment, and we bear no obligation to inform you of such changes. Placing an order signifies your offer to purchase selected products in accordance with the standard Site restrictions, specific restrictions imposed by our tailoring artisans, and the terms and conditions outlined below. The creation of an account is mandatory for product purchases, enabling easy access to order details and past purchases.
Our establishment assumes no liability for services or products provided by third-party vendors. We make no warranties to end users regarding the quality, safety, or usability of products or services supplied by merchants. For certain services or activities that may involve potential bodily harm, we disclaim responsibility for the service or activity being offered. End users are accountable for their own actions in utilizing these services, reflecting the essence of sartorial independence.

Welcome to our bespoke tailoring platform where we offer users access to a diverse range of clothing and accessories available for purchase at the prices listed on the site.
General Terms and Conditions
This Agreement outlines the terms and conditions governing the user's utilization of our tailoring platform. By engaging with this site, the user agrees to adhere to all stipulated terms and conditions. The right to access the site is personal and non-transferable. Users are responsible for safeguarding the confidentiality of their passwords. While we strive to maintain a secure online environment, the Company cannot be held liable for data loss during internet transmissions. Although our objective is to ensure 24/7 accessibility, routine maintenance may cause temporary unavailability. Users acknowledge that, due to circumstances both within and beyond the Company's control, access to the site may be interrupted or terminated. The Company reserves the right to modify or discontinue any aspect of the site, including content, availability hours, and access requirements.
Versatility Membership Criteria
The use of our tailoring services is restricted to individuals capable of forming legally binding contracts under the Indian Contract Act, 1872. Those deemed "incompetent to contract," such as minors and un-discharged insolvents, are ineligible to use the site. Minors, under 18 years of age, are prohibited from registering as site members. Purchases or sales on behalf of minors must be conducted by their legal guardians or parents who are registered users. Membership termination may occur if it is discovered that a user is under 18 years of age.
Your Tailoring Account
By using the tailoring site, you affirm that you are of legal age to form a binding contract and not barred from receiving services under applicable Indian laws. Providing accurate and current information during registration is essential, and any misinformation may result in account suspension or termination. Users are responsible for maintaining account confidentiality, and any transactions or disputes arising from misuse will not be entertained. Immediate notification of unauthorized account use or security breaches is required. The Company reserves the right to refuse service, terminate accounts, or edit content at its discretion.
Access to Secure Areas
Access to password-protected and secure areas is limited to authorized users. Unauthorized attempts to access these areas may lead to legal prosecution.
Your Tailoring Information
"Your Information" refers to any data provided during registration, in feedback areas, bulletin boards, chat services, etc. Users are solely responsible for their information, and the Company may act as a conduit for online distribution and publication in accordance with site features.
In the realm of bespoke tailoring, the emphasis shifts from Versuitality to the versatility of tailored creations. The precision in crafting unique garments is comparable to the meticulousness required in adhering to the Information Technology (Intermediaries guidelines) Rules 2011.
In the event of non-compliance with these rules and regulations, in alignment with the Information Technology (Intermediaries guidelines) Rules 2011, the tailoring agreement and privacy policy for access or usage of the intermediary's services reserve the right to promptly terminate access or usage rights and remove non-compliant information.
Your choice of fabric for customization should not include materials that: (a) are owned by another person without proper rights; (b) possess characteristics that are grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful; (c) cause harm to minors; (d) infringe upon any patent, trademark, copyright, or other proprietary rights; (e) violate any current law; (f) deceive or mislead the recipient/users about the origin of such details or convey offensive or menacing information; (g) involve impersonation; (h) contain software viruses or any other computer code intended to disrupt, destroy, or limit the functionality of any computer resource; (i) pose threats to the unity, integrity, defense, security, or sovereignty of the bespoke tailoring community, friendly relations with other tailors, or public order or incite the commission of any cognizable offense or prevent the investigation of any offense or insult any other tailor; (j) should not create liability for the tailoring services or cause the loss of services.
In the realm of bespoke tailoring, the platform may offer tailors the ability to communicate with each other and clients. There is no obligation to scrutinize all communications, information, or content ("Tailored Postings") shared by tailors and clients, and there is no assumed responsibility or liability concerning such Tailored Postings. However, periodic monitoring may occur, and the platform reserves the right to reject or remove any communication or Tailored Postings that violate the stipulations outlined in this Clause.
To enhance the tailoring experience and create unique garments tailored to your preferences, you agree to grant the tailoring service a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to utilize the creative and design aspects (but no other rights) in the information you provide, across any known or future media, in accordance with the tailoring agreement and privacy policy.
Attire and Accessories
The Client is responsible for procuring and maintaining their bespoke tailoring essentials, including but not limited to, telephone, computer hardware, and other tools essential for accessing and utilizing our services. All associated charges are the sole responsibility of the Client. The Tailoring Company shall not be held liable for any damages incurred to the Client's tailoring equipment arising from the use of our services.
Color Accuracy
Although meticulous efforts have been made to present the colors of our tailor-made products as accurately as possible on the platform, we cannot guarantee that the display on your monitor or screen will be entirely precise. Variations may occur due to differences in computer monitors and electronic device screens.
Electronic Correspondence
When engaging with the tailoring services on our platform or sending emails or other forms of communication, you acknowledge that you are communicating with us through electronic records. By using our services, you consent to receiving periodic communications via electronic records from us, delivered through email or electronic notices on our platform, which will be deemed as satisfactory service of notice or electronic record.
LICENSE AND PLATFORM ACCESS
We hereby grant you a limited license to access and utilize the platform and its tailor-made services for personal use. This license excludes any downloading or copying of account information for the benefit of third parties, unauthorized hypertext links, or framing of content available through the platform. Additionally, actions such as uploading, posting, or transmitting unauthorized content, materials containing software viruses, or engaging in activities that may impose an unreasonable load on our infrastructure are strictly prohibited. Any unauthorized use will result in the termination of the permission or license granted by us.
Connections
The platform or third parties may provide links to other online resources. Given our lack of control over these external sites and resources, you acknowledge that we are not responsible for their availability. We do not endorse or accept responsibility for the content, advertising, products, or materials on or available from such sites or resources. Furthermore, we shall not be held responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available through any external site or resource.
Pricing Information for Versatile Tailoring Services
At Versuitality, our commitment is to offer you competitive prices for the bespoke tailoring products and services you choose from us. However, we do not claim to guarantee the lowest prices in the city, region, or geographical area. Prices and product availability are subject to change without prior notice. The prices displayed on our platform are not intended for direct comparison with similar products or services available through online or offline sales elsewhere. Our pricing is governed by a comprehensive policy, and the final prices are determined solely at our discretion.
While we make every effort to provide accurate product and pricing details, occasional errors in pricing or typography may occur. In the event of a product being listed at an incorrect price or with inaccurate information due to a pricing or product information error, we may, at our discretion, get in touch with you for clarification or cancel your order, notifying you of such cancellation. We reserve the right to adjust the product price, contacting you for further instructions via the email address or telephone number provided during registration, or cancel the order and inform you accordingly. If we proceed with accepting your order, the corresponding amount will be debited from your credit card account. Payment processing may occur before product dispatch. Should we need to cancel the order post-payment processing, the reversed amount will be credited back to your credit card account. Please note that no refunds are applicable for Cash on Delivery ("COD") orders.
Cancellation Policy
Versuitality holds the right to decline or cancel certain orders at its sole discretion. Situations leading to order cancellation may include limited quantities available, inaccuracies or errors in product or pricing information, or concerns about product quality. Additional verifications or information may be required before accepting an order, and we will contact you if any part of your order is cancelled or if more information is needed. If your order is cancelled after your credit card has been charged, the respective amount will be reversed to your card account.
User-initiated Cancellations
In cases of user-initiated order cancellations, we reserve the right to accept or reject such requests for any reason. If a cancellation notice is received before the order is processed or approved by us, we will cancel the order and refund the entire amount. Valid cancellation requests must be made within 24 hours of placing the order on our site. Orders that have already been processed or for which cancellation requests are made after 24 hours will not be eligible for cancellation. The user acknowledges and agrees not to dispute our decision regarding order cancellations and accepts our final decision on the matter.
Versatility and Account Integrity
In our pursuit of sartorial excellence, we consistently monitor the integrity of each user's account to safeguard against deceptive accounts and transactions. Individuals found maintaining more than one account or engaging in the fraudulent use of our services may face legal consequences under applicable law. We retain the right to seek compensation for goods, collection charges, and legal fees from those who misuse the Site. Legal proceedings may be initiated against individuals involved in fraudulent activities or any other unlawful acts that violate our terms and conditions. Should any fraudulent or declined transactions be detected, we reserve the right to promptly delete the associated account, cancel all past and pending orders, and disclaim any liability without recourse for refunds.
As artisans of bespoke tailoring, we assume no liability for any loss or damage arising directly or indirectly from the denial of authorization for a transaction. This may occur if the cardholder exceeds the mutually agreed preset limit with our acquiring bank.
Credit Card Information
In embracing the essence of versatility, we request that the credit card details provided for availing services on the Site be accurate and lawfully owned by the user. It is imperative that, in credit card transactions, individuals use their own credit cards. Users agree to furnish correct and valid credit card details, with an assurance that this information will only be shared for fraud verifications, legal compliance, or court orders. We explicitly disclaim any liability for credit card fraud, placing the responsibility on the user. The onus to 'prove otherwise' in cases of fraudulent card usage rests exclusively on the user.

ALL CONTENT, PRODUCTS, AND SERVICES ON THE SITE, OR OBTAINED FROM A WEBSITE TO WHICH THE SITE IS LINKED (A "LINKED SITE") ARE OFFERED TO YOU "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE COMPANY AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SHAREHOLDERS, AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, OPPORTUNITY, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SUCH DAMAGES MAY ARISE FROM THE USE OF THE SITE, SALE AND SUPPLY OF VERSATILE CONTENT OR ANY RELATED/UNRELATED SERVICES AND OTHER SERVICES OFFERED ON THE SITE FROM TIME TO TIME.
Versatility Clause:
You shall, to the widest extent possible, ensure the adaptability and versatility of our bespoke tailoring services, encompassing the Company, its subsidiaries, and affiliates, along with their respective officers, directors, shareholders, agents, and employees. This includes safeguarding against any claim or demand, encompassing reasonable attorneys' fees, initiated by a third party or penalties imposed due to or arising from your violation of this Agreement or the documents it integrates by reference. It also includes violations of any applicable law, rules, or regulations, or infringements upon the rights of a third party.
Flexible Pricing:
The cost of our bespoke tailoring service is inclusive of the relevant VAT, the application of which depends on the destination to which the customized order is shipped. The tax rate for the order is determined by the combined rate for both state and local taxes, corresponding to the address of shipment. We maintain the right to collect taxes for shipping charges wherever applicable.
Adaptable Delivery:
We endeavor, though without absolute assurance, to deliver tailor-made products to Users within 3-4 weeks from the conclusion of the sale, contingent on the shipping location. Various factors may influence delivery times, including delays with the courier partner or transport disruptions. We reserve the right to deliver goods in installments, with each delivery forming a distinct contract. Failure to accept delivery may result in additional shipping charges at our discretion.
Tailored Insurance:
Every bespoke purchase is insured during transit until it reaches your designated delivery address. The responsibility is transferred to you upon delivery, for which a signature is required. If a third party is specified for delivery (e.g., as a gift), their signature serves as evidence of delivery and fulfillment. Dispatch is aimed to occur within 24 hours, or 48 hours during sale periods. Estimated delivery times are indicative, and we bear no liability for delays caused by third-party delivery agencies or statutory clearances.
Adaptable Circumstances:
There may be instances where confirmed orders cannot be fulfilled due to reasons such as unavailability, poor quality, or inaccuracies in product information. In such circumstances, you are not entitled to damages or monetary compensation.
Refund Flexibility:
In the event of the inability to deliver a confirmed order, and payment was made through credit/debit card, the amount paid will be reimbursed to your card account. No refunds are applicable for orders made under the Cash on Delivery option.
Versatility
The hallmarks, emblems, and service marks ("Marks") showcased on our bespoke tailoring platform are our proprietary assets and/or the possessions of respective individuals. Users are expressly forbidden from utilizing any Marks for any purpose without obtaining our prior written consent or the consent of the third party holding the rights to the Marks. All information and content, including any bespoke tailoring software programs, accessible on or through our platform ("Content"), is safeguarded by copyright. Users are strictly prohibited from altering, replicating, disseminating, transmitting, showcasing, publishing, vending, licensing, creating derivative works, or utilizing any Content for commercial or public purposes.
Our platform contains copyrighted material, trademarks, and other proprietary information, encompassing but not limited to text, software, photos, video, graphics, music, sound, and the entire contents of our bespoke tailoring service protected by copyright as a collective work under applicable copyright laws. We possess the copyright in the selection, coordination, arrangement, and enhancement of such content, as well as in the original content. Users are not permitted to modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit any content, either in whole or in part. Users may download/print/save copyrighted material for personal use only. Unless expressly stated otherwise under copyright law, no copying, redistribution, retransmission, publication, or commercial exploitation of downloaded material without the explicit permission of our company and the copyright owner is allowed. If copying, redistribution, or publication of copyrighted material is permitted, no changes in or deletion of author attribution, trademark legend, or copyright notice shall be made. Users acknowledge that they do not acquire any ownership rights by downloading copyrighted material. Trademarks located within or on our platform shall not be deemed public domain but rather the exclusive property of our company, unless under license from the trademark owner, in which case the license is for the exclusive benefit and use of our company unless otherwise stated.
General
None of the provisions in this Agreement shall be construed to establish a partnership or agency between users and our bespoke tailoring company, and users shall have no authority to bind the company in any manner. Unless explicitly stated otherwise, notices shall be given by postal mail to our corporate address or to the email address provided during the registration process. Notice via email is considered given 24 hours after it is sent, unless the sender is notified of an invalid email address. Alternatively, notice may be given by certified mail, postage prepaid, and return receipt requested, with a deemed delivery three days after the mailing date.
If any clause of this Agreement is deemed invalid or unenforceable, it shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses. This Agreement constitutes the entire understanding and agreement between users and our bespoke tailoring service.
In the company's sole discretion, it may transfer its rights and obligations under this Agreement without users' prior express consent.
If users breach this Agreement, the Privacy Policy, or the referenced documents, and we take no action, we retain the right to exercise our rights and remedies in any other situation where a breach occurs.
Versatility Sale and Advantages:
The Winter-Wave Sale
The Winter-Wave Sale benefits/discounts cannot be combined with any other code or discount or advantage.
Product(s) purchased can be returned or exchanged for a full refund of the paid price or a different product within 60 days from the date of receiving the order.
In the event that a product(s) is found to be damaged/incorrect upon receipt, please contact the customer service team for resolution.
It is mandatory to register to avail Member exclusive benefits.
First-time user benefit:
The code is valid for one-time use, by first-time purchasers only.
The code cannot be combined with any other offer code or Versatility points.
The code is only valid for purchases using the same email address that is used for registration.
Codes generated through multiple email IDs of the same user will not be accepted. Orders placed through misuse will be cancelled.
The offer expires 15 days after the code is emailed to you.
Products can be returned/exchanged per our normal policy. The offer will be adjusted accordingly on return or exchange.
Special benefits:
Special benefits received via email to customers only cannot be combined with any other offer and are valid until the date mentioned in the email.
Arbitration
If any dispute arises between you and the Company during your use of the Site or thereafter, in connection with the validity, interpretation, implementation, or alleged breach of any provision of this Agreement, and the Privacy Policy or the documents they incorporate by reference, the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party identified by the Company. The place of arbitration shall be Hyderabad.The Arbitration & Conciliation Act,1996,shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language.
Governing Law
This Agreement, and the Privacy Policy or the documents they incorporate by reference, shall be governed and construed in accordance with the laws of India, with exclusive jurisdiction conferred on the courts at New Delhi.
The Company reserves the right to terminate this Agreement at any time. Without limiting the foregoing, the Company shall have the right to immediately terminate any passwords or accounts of the User in the event of any conduct by the User that the Company, in its sole discretion, considers to be unacceptable or in the event of any breach by the User of this Agreement. Despite any other provisions of this Agreement or any general legal principles to the contrary, any provision of this Agreement that imposes or contemplates continuing obligations on a party will survive the expiration or termination of this Agreement.
Following General T&C's are applicable for all products on sale at a discounted price by Versuitality, a purveyor of bespoke tailoring:
Sale discounts are exclusively valid for products marked as discounted, as specified on the website.
The discounted prices are only applicable during the specified period of the discount, as outlined on the website.
Returns and exchanges adhere to the terms and conditions defined during the sale period.
No additional discounts or coupons can be applied to the purchase of any discounted product.
In the event that a sale product is received damaged, please contact the customer service team for resolution. If the damage is confirmed by Versuitality customer service, an exchange will be offered for the damaged product(s). If a similar item(s) is unavailable for exchange, a full refund will be processed in such cases.
We Pledge:
This unique code is for single-use only.
The code will expire 365 days from April 20, 2022, to April 20, 2023.
This code cannot be combined with any other discount code, festive sale, or EOSS.
It is applicable only for purchases on www.versuitality.com.
The code can be used once and only by the intended recipient, i.e., the coupon code will work only with designated email IDs assigned by Versuitality.

Terms and Conditions:
Versuitality reserves the sole discretion right to cancel or amend orders if misuse is detected.
